This Privacy Policy (“Policy”) details how MasteryPrep LLC (“MasteryPrep”, “we” or “us”) collects, shares, and utilizes information provided to it by its customers and the website visitors at https://masteryprep.com. You are not required to provide any Personal Information or other data to use MasteryPrep’s website. However, you may choose to contact us by completing the form provided in the ‘Request a Demo’ page of this website. Data submitted to us will be used to fulfill the purposes for which they were collected.

MasteryPrep is committed to student growth and success, while maintaining their privacy. We are similarly committed to ensuring that our customers truly understand how we store and collect the information gathered while our products are in use.

By utilizing and enjoying MasteryPrep’s technology products and/or allowing your minor child to do the same, you hereby agree and consent to the terms of this Privacy Policy and any other policies posted on MasteryPrep’s website. MasteryPrep acts as a service provider and/or data processor on behalf of educational institutions who serve as data controllers.

II. What is Personal Information? 

“Personal information” is that information used to identify, describe, or is reasonably capable of being associated with or linked, directly or indirectly, with a person or his/her household. This includes, but is not limited to, the following:

  • Identifiers such as a real name, alias, postal address, unique personal identifier, online identifier, internet protocol address, email address, account name, social security number, driver’s license number, passport number, or other similar identifiers.
  • Biometric information.
  • Internet or other electronic network activity information regarding a consumer’s interaction with an internet website, application, or advertisement.
  • Geolocation data.
  • Audio, electronic, visual, thermal, olfactory, or similar information.
  • Education information, defined as information that is not publicly available personally identifiable information as defined in the Family Educational Rights and Privacy Act (20 U.S.C. Sec. 1232g; 34 C.F.R. Part 99).

“Personal information” does not include information that is lawfully made available from federal, state, or local government records and further excludes deidentified or aggregated consumer information.

III. Information Collected by MasteryPrep 

Because of the interactive nature of MasteryPrep Services, we collect different types of information that come from a variety of sources.

A. Schools, Teachers, and Administrators

We collect the following Personal Information when a School, Teacher, or Administrator creates a MasteryPrep username:

  • First and Last Name;
  • Email Address;
  • Class Name;
  • School Name; and
  • Password for the MasteryPrep account.

B. Students (Including Students Under 13) 

A School, Teacher, or Administrator will create Student Accounts on the Student’s behalf for each Student that receives parental consent to use MasteryPrep. MasteryPrep collects the following personal information to create each Student Account:

  • First and Last Name of Student; and
  • Password for the MasteryPrep account.
  • Student Email Address
  • Student Username

We use this information to provide products to our customers to inform and improve both instruction and our products. We do not use Personal Information for any other purpose or sell any individual’s Personal Information.

C. Website Users

  1. Information That You Provide to Us on Our Website

    We collect Personal Information or other data that you choose to provide us. For example, we may request Personal Information and/or other data when you contact us, request a demonstration, or apply for an open position. Do not submit Personal Information or other data on behalf of another individual, as doing so will warrant to us that you represent that individual and have their permission to submit the information to us.

    The categories of Personal Information or other data that we may collect from you depends on the purpose of the interaction, but may include:

    • Unique Identifiers that we may use to identify you individually, such as your name, telephone number, postal or email address.
    • Demographic Information, which may include sensitive information about protected classifications, such as your age or gender.
    • Professional and Educational Information relating to your occupation, such as your current or previous employers, your job title, or other information about the organization with which you are affiliated. You might also provide information about your professional qualifications or your education, degrees, fields of study, the institutions you’ve attended, languages, professional memberships, qualifications, and certifications.
    • Information that may be voluntarily provided in a resume or cover letter such as race, sexual orientation, marital status, or veteran status
    • Location Information, such as your city, state, province, and country.
    • Audio and Visual Information, such as your voice and likeness as captured in photographs, video, or audio recordings if you are captured on our security footage, leave us a voicemail, or include a photograph on any software user accounts hosted by us.
    • Preferences on communications with MasteryPrep.
    A website user should generally be able to visit our website without providing Personal Information, though we may still collect Personal Information or other data automatically as described in the next section.

  2. Information Automatically Collected or Generated

    Some information is automatically collected or generated. MasteryPrep and the vendors we work with, automatically collects certain Personal Data about you when you access or use our website employing various tools and technologies, including cookies, web server logs, and other tracking technologies. Automatically collected information may include information about visitors to our website and how they use our website, such as IP addresses, device identifiers, browser characteristics, operating system details, referring URLs, and pages or content viewed.     • Location Information – In accordance with your device permissions, we may collect information about the precise location of your device. You may stop the collection of precise location information at any time by adjusting your device’s settings.
    • Other Tracking Technologies – Web beacons (“tracking pixels” or “internet tags” or “clear gifs”) are small graphic images embedded in web pages that can be used, for example, to count the number of visitors on a website, to see how users interact with pages on the website, or to count how frequently certain content is viewed. Embedded scripts use programming code to collect similar information about your interactions with the Site. Embedded scripts are temporary and only active while you are interacting with our Site.

IV. Notice to Parents About Consent 

A. Parental Consent

MasteryPrep is a private, educational technology service provider offering instructional support tools for schools and districts. MasteryPrep requires consent from parents to collect and store Personal Information belonging to students (18 and under) through its customers, namely schools, school districts, teachers, and partners. MasteryPrep relies on our customers, being schools and districts, to obtain parental consent, as required by Children’s Online Privacy Act (COPPA) and the Family Education Rights and Privacy Act (FERPA).

If we discover that we are collecting information from Students without parental consent, we will delete this information as quickly as we can. If you believe that a Student participant may be participating in the MasteryPrep Services without parental consent, please notify us immediately at [email protected]. Please note that MasteryPrep will need to verify the identity of anyone requesting information about a child under the age of 13 to ensure that the person is in fact the child’s parent or legal guardian.

B. Students Account & Moderation 

Teachers and Administrators can monitor and moderate all Student content associated with his or her own classroom. Students will not be able to create a MasteryPrep account on his or her own behalf. Parents and guardians should always consult their school’s Acceptable Use policies and practices for protecting their children on the Internet.

C. Parental Access to MasteryPrep Information

A parent or guardian of a student under 18 years old may have the ability to request information from MasteryPrep regarding the type of data being collected, view your child’s information and online activity, and, if you choose, request that we stop making further use of your child’s information. Parents with children under the age of 13 may have additional rights under the Children’s Online Privacy Protection Act (“COPPA”). V. How Information is Stored 

In addition to the uses described above, and subject to any restrictions imposed by applicable law or our agreement with our customer, we may use and disclose the information we collect:

  • To permit our customers and their authorized users (i.e., administrators and teachers) to tailor and optimize the use of our products to the needs of a school, classroom, or student.
  • To permit school administrators and teachers to review students’ work, monitor students’ performance and progress, and otherwise support instruction.
  • To offer students immediate feedback and continuous support, suggest other content or activities, help them track their own progress and maintain a file of their work, and modify instruction to meet their needs.
  • To personalize user experience (i.e. displaying his or her name on the user dashboard).
  • To understand how our products are accessed and used and how they perform so that we may improve our products and services. We also develop analytics studies that contain only aggregate anonymous information.
  • To provide our school and school district customers with various types of reports (i.e. performance and progress of a school district, school, classroom, and/or student).
  • To communicate with administrators and teachers.
  • To diagnose and resolve problems and provide maintenance and support for our products.

VI. Information Sharing with Third Parties 

MasteryPrep does not disclose any Personal Information about our users to any third party, except:

  • With your consent and at your direction.
  • As directed by our school district customer.
  • To our third-party service providers, who provide services such as website hosting and customer service.
  • With our professional advisors (e.g., lawyers, bakers, insurers).
  • To the extent we believe it necessary or appropriate to comply with legal process or to respond to requests from government authorities.
  • To the extent we believe it necessary or appropriate to protect our rights, safety, or property and/or that of our affiliates, our customers, or our users.
  • In the event of any reorganization, merger, sale, joint venture, assignment, transfer, or other disposition of all or any portion of our business, assets, or stock (including in connection with any bankruptcy or similar proceedings), in which case the transferred information will remain subject to the terms of this Privacy Policy.
  • For any purpose disclosed at the time you provide your information or request a service from us.
  • For any purpose consistent with this policy or otherwise allowed by applicable law.

When you contribute to a public area or feature of our website, such as a bulletin board, list serve or blog the information that you submit will be made available to the public. Therefore, we recommend that you do not submit any sensitive information to such areas of our website, including your full name, home address, phone number or any other information that would enable other users to locate you or contact you.

MasteryPrep maintains a list of third-party subprocessors, and that list can be made available upon request. All subprocessors are contractually bound to comply with all applicable data privacy and security requirements. We are willing to enter a Data Protection Addendum upon request from a school district. We will maintain FERPA-compliant agreements with each school district as required.

VII. Rights to Information

Federal and state laws permit students and their parents/guardians the following rights regarding the Personal Information collected by MasteryPrep:

  • The right to request the destruction of your/your child’s Personal Information;
  • Know what Personal Information was collected;
  • Know what Personal Information was disclosed to third parties;
  • Update or correct such information if you believe there is an inaccuracy;
  • Object to the use of Personal Information; and
  • Request transmission of Personal Information to another party.

Depending on the local laws of your individual state, regular website users may have certain rights regarding Personal Information and/or Personal Data that we collected about you. State specific rights may be found on your state Attorney General’s website, which MasteryPrep will endeavor to honor.

MasteryPrep does not discriminate against any individual for exercising these rights. However, please be advised that the deletion or restriction of Personal Information may prevent a child from enjoying and/or participating in MasteryPrep services. To exercise any of your rights, please email [email protected] and state your desired action in the subject line and notify the school, school district, and teacher of the same request as MasteryPrep may not be the custodian of the Personal Information.

MasteryPrep is not responsible for the content or privacy practices of any linked websites that it does not control. In addition, we are not responsible for the privacy, information or other practices of other organizations, such as Apple, Google, Microsoft, RIM, or any other device manufacturer, app developer, provider of an app, social media platform, operating system, or wireless service.

IX. Social Media Interaction

Links and other features of our website may permit you to initiate interactions between MasteryPrep and social network platforms by unaffiliated companies. If you choose to “like” or share content or other information on a social media platform, that information may be publicly displayed and the company operating the platform may receive information about you and your use of our website. Similarly, if you interact with us through social media, we may have access to information about you from the social media platform. Please note that if you mention MasteryPrep, or comment about or in response to us, in your post on a social media platform, that platform may allow us to publish your post on our website. We may also receive information about you when that information is accessible through another user’s social media. X. Communications and Opting Out

By volunteering your Personal Information, such as an email or phone number, you acknowledge that MasteryPrep may now contact you via email or SMS for various purposes, which could include marketing and promotional content. Message and data rates may apply. However, You may elect not to receive promotional correspondence from us at any time.

Reply STOP to opt out of any SMS messages. If you do not wish to have your contact information used by us to promote our services, you can opt-out by sending us an email stating your request to [email protected]. In this e-mail, please say whether: (i) you would like to opt out of receiving all e-mail promotional correspondence from us in general or (ii) if you would only like to opt out of certain of our e-newsletters or correspondence and if so which ones or (iii) you would like to opt out of receiving SMS or text messages. MasteryPrep considers numerous factors to determine the length of time we retain information, including any legal obligations, if the data is needed to resolve disputes, make and defend legal claims, comply with law enforcement investigations, conduct audits, pursue legitimate business purposes, and/or enforce agreements. At the appropriate time, we will take reasonable steps to destroy the information, except when we need to retain such information to satisfy legal or professional obligations.

We may change this Privacy Policy from time to time. The “Last Updated” legend at the top of this page indicates when this Privacy Policy was last revised. Any changes will become effective when we post the revised Privacy Policy or, in the case of any material change, provide the revised Privacy Policy to our school district customer, who agrees to the Privacy Policy, and any revisions to it, on behalf of its administrator, teacher, parent or guardian, and student end users.

All subprocessors are contractually bound to comply with all applicable data privacy and security requirements. We are willing to enter a Data Protection Addendum upon request from a school district. We will maintain FERPA-compliant agreements with each school district as required.

VII. Rights to Information

Federal and state laws permit students and their parents/guardians the following rights regarding the Personal Information collected by MasteryPrep:

  • The right to request the destruction of your/your child’s Personal Information;
  • Know what Personal Information was collected;
  • Know what Personal Information was disclosed to third parties;
  • Update or correct such information if you believe there is an inaccuracy;
  • Object to the use of Personal Information; and
  • Request transmission of Personal Information to another party.

Depending on the local laws of your individual state, regular website users may have certain rights regarding Personal Information and/or Personal Data that we collected about you. State specific rights may be found on your state Attorney General’s website, which MasteryPrep will endeavor to honor.

MasteryPrep does not discriminate against any individual for exercising these rights. However, please be advised that the deletion or restriction of Personal Information may prevent a child from enjoying and/or participating in MasteryPrep services. If you choose to “like” or share content or other information on a social media platform, that information may be publicly displayed and the company operating the platform may receive information about you and your use of our website. Please note that if you mention MasteryPrep, or comment about or in response to us, in your post on a social media platform, that platform may allow us to publish your post on our website. Reply STOP to opt out of any SMS messages.
